When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

4 RepliesI need feedback of any K-1 applicants who are NOT South African Nationals. There is K-1 interview scheduled to be next month for an applicant residing in another African country due to his employment. He is NOT from South Africa. We are having trouble 1. finding information about bringing a Spanish interpreter for the interview 2. A document review appointment needed 2 weeks prior to the interview. The issue is the applicant may not be able to attend that document review appointment and we fear his interview may get cancelled. I have emailed both JohannesburgIV@state.gov and SouthAfrica.Visas@gdit-gss.com. Still waiting on responses, but time is ticking. Also calling the consulate only resulted in pointing us back to their website... Any insight will be immensely appreciated.

Two questions about the I864A:
1) If my household sponsor, my mother, doesn't know her retirement date, should we just leave out filling in the date? Or should she give an approximate date?
2) If my mother's surname on my birth certificate is now different, will I have to ask my mother for her marriage certificate with my step dad?
For example...her name on my birth certificate says Jennifer Smith, but now she's Jennifer Smith Jones. Or, will this detail not matter to USCIS?

7 RepliesHi, I just gor my greencard last monday and now want to visit my home country as soon as possible. I just suffered a loss of a family member and I am planning to go over there for around 6 weeks. After that I am hoping to start a job here in the U.S. (already applying atm).
Traveling abroad should not be an issue, right? For returning back to the U.S. I was gonna bring my marriage cert, my greencard and the approval letter and maybe a few more USCIS docs I received throughout the last months.The only thing that worries me a bit is that my passport still is in my "old name" while my greencard has my new name (we hyphenated our last names). However, that should be covered by having the marriage cert. as proof of legal name change, is that correct?
I was going to book my flight tickets in the name that my passport shows (= old name).Some confirmation or anything else I may need to worry about would be very much appreciated here. thank you!

I wanted to know if this info is still up to date.
- When my K1 case is approved and I receive the NOA2, I need to wait until it shows ''Case Ready''. After that I can complete the DS-160 and pay the $265 fee, right?
I just know the DS-160 will expire 30 days if not finished, but if I finish it then it's okay, right? Or USCIS delays might affect the situation?
- Also, question for those who have completed their DS-160, did the webpage after finishing it asked you to pay the fee and then after paying you were able to choose the interview date? Or did you need to visit completely different page to pay the fee and book the interview?
- Ahhh, and another question - for the DS-160 - should I be picking that K1 is a non-immigrant visa or immigrant visa? Because I remember someone saying that there is a little detail when filling the DS-160. It was the same when You're at the U.S. embassy that you need to pick immigrant visa or the opposite.. I don't remember..
I checked this but it doesn't mention DS-160 and it says that the Embassy issues Beneficiary with Interview date, but what I understand from everyone that when they have paid for DS-160 they immediately can book their interview date by themselves.

3 RepliesI am currently in the U.S. and my non-immigrant visa has already expired. My husband (a U.S. citizen) and I have filed for Adjustment of Status (AOS) to apply for my green card. We sent the documents and the fee has already been charged from my husband s card, which means USCIS has received my application.
However, I haven t received my NOA (Notice of Action, Form I-797C) in the mail yet, so I don t have an official paper to prove my pending status.
I plan to take a domestic flight soon, but I am a bit worried about traveling without my NOA. Do you have any experience with this? Did TSA or airport officers ever ask you for immigration documents while flying domestically?
Any advice or shared experiences would be really helpful. Thank you!
